1. INTRODUCTION AND DEFINITIONS

In these Rules:

• “the Company” means Evolve Fitness Studio Limited

• “the Club” means Evolve Fitness and Recovery

• “Member” means a Studio member

• “Rules” mean these terms and conditions of membership

• It is a condition of membership that Members agree to pay the fees outlined in Rule 2 and be bound by these Rules.

• The Company may alter these Rules from time to time. Updated versions will be published on www.studioevolve.co.uk.

2. MEMBERSHIP AND FEE

• Members must be at least 18 years old.

• A non‑refundable joining fee is due at signup.

• Membership payments are monthly in advance via Direct Debit from a UK bank account.

• Lump‑sum annual prepayments are not offered.

• All memberships now run on a 1‑month rolling basis, payable by the 1st of each month (or next working day).

• Members must keep contact details up to date.

• All communications are assumed received 5 days after sending.

• Membership fees are reviewed annually (typically 1 January) with one full calendar month’s notice.

• The Company may refuse membership applications at its discretion.

• A photo is required before first entry.

• Membership is non‑transferable and non‑refundable.

Late payment policy:

• If fees are unpaid, access may be suspended until payment is made.

• After 30 days overdue: full payment is required.

• After a further 15 days: membership is terminated, and the Company may pursue recovery.

• Missed payments may incur collection fees.

• No refunds are given on termination.

• Rejoining requires clearing all outstanding amounts and paying a new admin fee.

• Transfers between clubs may incur fees and adjusted monthly rates.

Membership changes (e.g. upgrades/downgrades/transfers):

• Requests must be submitted in writing (via app or email) by the 24th of the month to take effect the following month.

3. MEMBERSHIP & ACCESS

• Issued upon ID verification; required for access.

• Non‑transferable; misuse may lead to termination without refund.

• Replacement cards may be subject to a fee.

MEMBERSHIP CONTRACT TERMS

• You may apply to become a member by completing the registration form and agreeing to these Terms and Conditions.

• You must confirm that you are 18 or over, a Consumer, and that your details are correct.

• Membership is confirmed only after acceptance and receipt of the Membership Fee.

• The contract begins on our acceptance and your payment.

• The initial period is one month, after which it rolls monthly until cancelled.

• We may suspend, refuse to renew, or cancel your membership if your conduct is unacceptable or harmful to the Club’s reputation.

• No refunds are provided for suspended, revoked, or unused sessions.

• Treatments included are non-transferable.

• One treatment session per day per treatment type.

• You may bring one guest for Sauna or Cryotherapy only, and they must attend at the same time as you.

Gift Vouchers:

• Emailed upon successful payment to the provided email address.

• Redeemable for Treatments or Packages online or in person.

• Non-refundable and not eligible for a cooling-off period.

• Valid for 12 months from date of purchase.

• No cash refunds on cancelled bookings made with vouchers.

4. USE OF FACILITIES AND SERVICES

• Studio etiquette and inclusive policy apply.

• Hours may change without notice.

• Weekend access (where offered) runs from Friday 2 pm until Sunday closing and on Bank Holidays.

• The Studio may close for maintenance, events, or holidays.

• Only staff or approved third parties may deliver personal training.

• Arrive 10 minutes before classes; late arrivals may be refused.

• Entry may be refused at the Company’s discretion.

• Activities are at the Member’s/guest’s own risk; seek medical advice where necessary.

• Appropriate attire and footwear required; no topless training or glass containers.

• Wet-area etiquettes (showers and saunas) must be followed; health advisories apply.

• CryoSpa/Cryotherapy use is under staff guidance; medical consultation is recommended.

• No pets or smoking.

• No alcohol or drugs onsite—violations may result in expulsion and termination.

• Discreet phone use allowed except in wet areas or lounges; no video calls; photography rules apply.

• Equipment must be used and stored safely; cleanliness is required.

• Appointments require 48hours’ notice or full charges apply.

5. LOCKERS

• Bags must be stored in lockers and coat hanging area provided.

• Unclaimed items are held (wet: 48 hours; dry: 14 days) then donated.

• Daily lockers available—contents must be removed at the end of each visit.

6. LIABILITY

• The Company is not liable for loss/damage to personal items.

• All activities are at your own risk.

• Injury liability is accepted only for proven wilful neglect.

• Accidents/injuries must be reported immediately to the Duty Manager.

7. MEMBER’S HEALTH AND SAFETY WARRANTY

• Members and guests confirm they are physically fit and must inform staff of any conditions or seek medical clearance.

• No use of facilities with infectious conditions or open wounds.

• Familiarise yourself with fire exits; emergencies require immediate evacuation.

8. DATA PROTECTION

• Please refer to our Privacy Notice for data handling policies.

9. CANCELLATION OF MEMBERSHIP

• Membership is on a 1‑month rolling basis paid in full in advance.

• Cancellation requests must be received by the 1st of the month via the app or email.

• Notices cannot be submitted in the same month as joining.

• One full calendar month’s payment is required after notice.

• Confirmation is emailed within two working days.

• Cancellation is only valid once confirmed.

• No benefit changes allowed during the notice period.

• No refunds for prepaid or unused benefits.

• Expelled members forfeit all privileges and fees.

Rescheduling for Non-Members:

• Cancel with more than 48 hours’ notice to avoid charges.

• Cancel with less than 48 hours’ notice = full charge.

• Rescheduling is allowed once with 48 hours’ notice, within 30 days of original date.

• Missed sessions not rebooked within the month cannot be carried over.

Payments and Contracts:

• Monthly payments via Direct Debit or standing order, in-clinic card, or cash (pre-arranged).

• Contracts are formed upon sending of the Booking Confirmation email.

• Refunds (if applicable) are issued within 14 calendar days.

• Cooling-off rights apply to Consumers who cancel within 14 days (exceptions apply).

• No cooling-off applies for Gift Vouchers or business purchases.

• You may cancel for breach or if treatments are unavailable for over 90 days.

10. CCTV

• CCTV operates throughout the club (some front-of-house areas include audio).

• Underwater cameras monitor pools.

11. COMPLAINTS AND FEEDBACK

• Feedback is welcomed.

• For complaints, contact us via email or post .

12. GENERAL

• The Company may assign membership agreements to third parties.

• Communications may be via email or SMS.

• Leave fitness and wet‑area spaces 20 minutes before closing time.

• Annual maintenance closures may occur.

13. STUDIO CREDIT

• Sessions credit may be used for spa products or personal training top-ups.

• Credit and guest pass purchases are non-transferable and expire after one year.

• Referral credit applies only if the referred member stays 2+ months.

• Unused credit or sessions are non‑refundable upon departure.
